Vibe Kids Terms of Service

These Terms of Service ("Terms") govern your access to and use of Vibe Kids (the "Service"), including the website, web application, and any related features. The Service is operated by Anchored Imagination LLC ("Vibe Kids", "we", "us", or "our").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
How updates work. We may update these Terms as Vibe Kids evolves. When we make a material change, we post the updated Terms here with a new "Last updated" date. Continuing to use Vibe Kids after an update means you accept the updated Terms.
1. What Vibe Kids Is
Vibe Kids is a supervised, hands-on learning experience that helps young children (roughly ages 6–10) learn the thinking behind software — rather than the syntax of a particular programming language — by building small, self-contained HTML games and interactive pages together with an AI coding companion ("Vibe").
A lesson is finished when the child can both build with the idea and explain it in their own words, so progress reflects understanding rather than time spent.
The Service is not designed for independent use by children. It is built for parents/guardians who log in and learn together with their children. The adult must be present and, for the youngest kids, typically types and guides. The adult is the account holder and is responsible for the session. There is no separate child login.
2. Accounts, Eligibility, and Parental Consent
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create a parent account.
- During our current early-access phase, sign-ups may be gated (waitlist / invitation). We may change or remove this later.
- Parental consent is required. When you create a parent account you must confirm, at signup, that you are the parent or legal guardian and that your child uses Vibe Kids with you present. We record this consent along with the wording in effect at that time.
- You are responsible for keeping your password secure and for all activity under your account.
- Child profiles are created by a parent. Children do not create or control their own accounts and there is no separate child login; the parent selects the active child.
You may not create an account for someone else without authorization, impersonate anyone, or use the Service for any illegal purpose.
Where the Service is offered (geographic scope). The Service is not directed to, offered to, or intended for individuals located in the European Union, the European Economic Area, the United Kingdom, or Switzerland, and we do not seek to collect or process the personal data of individuals located in those regions. We block access from those regions at the network level, and requests from them receive an HTTP 451 response. IP-based location is not perfect, so this measure is not a guarantee: if you are located in a region we do not serve, please do not use the Service, regardless of whether you are able to reach it. We may change the regions we serve at any time; this section will say so when we do.
3. How the Service Works (Key Safety and Supervision Rules)
- Vibe can only do one thing: write a single small HTML file — the child's game. It has no access to your device, your files, your network, or anything else on our systems, and it cannot read other families' data. Every build session is isolated, runs under strict resource limits, and is thrown away when the session ends.
- Every prompt and every piece of generated output is screened by an automated safety system before output is shown, and all output is sanitized and wrapped with a strict Content Security Policy. The preview runs in a sandboxed iframe.
- The AI is instructed to build with the child one small step at a time, ask what to do next, and never take over the project.
- You (the adult) must be present to supervise the session, guide the child, and decide what is appropriate for your child.
- Do not use the Service to generate, request, or share content that is harmful, illegal, sexually explicit, violent, hateful, or that violates the rights of others.
We may block content, lock, suspend, or terminate accounts that abuse the Service, attempt to bypass the technical safeguards, or repeatedly produce or request inappropriate content. A locked account can contact us to request an unlock.
4. Your Content, Ownership, and How We Use It
- You and your child own the games and experiences you create ("Your Content").
- You grant us a limited license to host, process, display, and back up Your Content, and — as described in the Privacy Policy — to review the prompts you type and the games the AI produces in order to operate, keep safe, and improve the Service. We do not use Your Content to train foundation AI models, and we do not sell it or use it for advertising.
- We do not claim ownership of Your Content.
- You are responsible for ensuring that any content you or the child create (or ask the AI to help create) does not infringe anyone else's rights.
5. The AI Companion and Third-Party Providers
The "Vibe" experience is powered by open-weight ("open-source") AI models hosted by our inference provider, Fireworks AI.
- When you type instructions or the AI generates code, that information is sent to the AI provider to produce the edits. The provider processes it only to return the response and does not retain it or train on it. We do not route your child's data to AI providers that retain or train on it.
- The narrow single-file boundary above and our render pipeline are the primary safety boundaries, alongside automated safety screening of prompts and output.
- The specific open-weight model may change as we improve quality and speed.
We do not use your specific family conversations or builds to train foundation models.
6. Payments and Paid Plans
Some features or usage may require a paid plan.
- Payments are processed by Stripe; we do not store your full card details.
- Prices, what is included, and any billing terms are shown at the point of purchase. Taxes may apply.
- Unless stated otherwise at purchase or required by law, payments are for the plan or item described at checkout. Contact us with any billing questions.
- Refunds are governed by our Refund Policy, which includes a 14-day money-back guarantee.
7. Acceptable Use
You agree not to:
- Attempt to break out of the sandbox or the single-file boundary, access other users' data, or reverse-engineer the safety systems.
- Use the Service to create or distribute malware, phishing pages, or anything intended to harm others.
- Harass, abuse, or intentionally generate upsetting or inappropriate content for or with children.
- Share account access in a way that allows unsupervised or unauthorized use by children.
- Overload or abuse the infrastructure (we have concurrency and rate limits for a reason).
- Use the Service in any way that violates applicable law or the rights of others.
We may remove content and lock or suspend accounts that violate these rules.
8. Privacy
Your use of the Service is governed by our Privacy Policy (linked wherever these Terms appear). It describes the data we collect from parents and the child profiles they create; how transcripts and builds are handled; that we review prompts and builds to improve the Service; the role of the AI provider; the strong technical isolation we use; and your export and deletion rights.
Because this Service is for young children, we have designed it so that the adult (parent) is the account holder, is present during use, and is the decision-maker.
9. Disclaimers and Limitation of Liability
The Service includes AI-generated code and suggestions. AI output can be imperfect, repetitive, or occasionally inappropriate. The supervising adult is responsible for reviewing what is built and deciding whether it is suitable for the child.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES ABOUT UNINTERRUPTED OPERATION, THE SUITABILITY OF ANY PARTICULAR GAME FOR ANY PURPOSE, OR THAT THE AI WILL ALWAYS BEHAVE AS EXPECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law (including certain consumer protections).
10. Termination
You can stop using the Service at any time by logging out or deleting your account. Self-service account deletion (a complete purge of your family's data) is available from Parent → Settings.
We may suspend, lock, or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service (with reasonable notice where possible).
Upon termination, we handle your data according to the Privacy Policy and any legal requirements.
11. Governing Law and Venue
These Terms, and any dispute arising out of or relating to these Terms or the Service, are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Any such dispute will be brought exclusively in the state or federal courts located in the State of Washington, and you and we each consent to personal jurisdiction and venue there — except where the law of the state or country where you live does not allow this, in which case nothing in this section takes away protections that law gives you. Nothing here affects any right you may have to bring a claim in small-claims court.
12. Changes to the Service or These Terms
We are actively building the product. We may add or remove features, change the AI model, adjust limits, or update the safety systems. We will try to give notice of material changes.
We may update these Terms from time to time. The "Last updated" date will change. Continued use after changes means you accept the new Terms. If you do not agree, stop using the Service.
